Terms & Conditions

1. Definitions

• Customer / You / Your: any individual or entity who visits the Site, uses the Site, or purchases a product from us.

• Product(s): any item(s) available for sale through the Site (e.g., static-cling window tint sheets).

• Services: any related services offered by us in connection with the Products or the Site (e.g. customer support).

• Order: your request to purchase Product(s) from us via the Site.

2. Use of the Site

• You must be at least 18 years old or the age of legal majority in your jurisdiction to use this Site.

• You agree to use the Site only for lawful purposes. You shall not use the Site in any way that violates applicable laws, infringes others’ rights, or imposes an unreasonable load on our infrastructure.

• You agree not to attempt to gain unauthorized access to parts of the Site (e.g., administrative areas) or to interfere with the Site’s security, functionality or operations.

3. Orders, Pricing & Payment

• All orders are subject to acceptance by us. We may refuse or cancel an Order for any reason (e.g. product availability, errors in pricing or product description).

• Prices for Products are those stated on the Site at the time you place an Order. Prices may change without notice.

• Payment must be made by methods offered on the Site. By submitting your payment information, you represent that all information is true and that you are authorized to use the payment method.

• All payments are in Canadian dollars unless otherwise agreed.

4. Shipping & Delivery

• We will deliver Products to the address you specify when placing the Order. It is your responsibility to ensure the address is accurate.

• Delivery times are estimates only; delays may occur. We are not liable for delays caused by shipping carriers, customs, or other causes beyond our control.

• If any Product is damaged during shipping, you must notify us within 48 hours of receipt, provide photographic evidence, and retain the packaging.

5. Returns, Refunds & Replacements

• Because TempTint Products are removable static-cling sheets, once applied or used, products may not be eligible for full refund, except under warranty or as required by consumer law.

• If you receive defective or incorrect Products, we will replace them, or issue a refund at our discretion, provided you notify us within 7 days of receipt and comply with our return instructions.

• Returns must be in original condition, unused (unless defective), with all packaging, tags, and instructions.

• You may be responsible for return shipping costs, unless the Product was defective or we made an error.

6. Warranty & Limitation of Liability

• We warrant that upon delivery, the Product will conform to its description and be free from defects in materials and workmanship for a period of 30 days from delivery.

• Our liability is limited to replacement or refund of the purchase price of defective Products.

• To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive or consequential losses or damages, including loss of profits, revenue, reputation, business, or data, even if we have been advised of the possibility of such damages.

• Our total liability to you under or in connection with these Terms shall not exceed the amount you have paid for the specific Product(s) in question.

7. Intellectual Property

• All content on the Site (including text, graphics, logos, images, design, software, code) is our property or the property of our licensors and is protected by copyright, trademark, and other intellectual property laws.

• You may view and print pages from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, transmit, create derivative works of, display, or in any way exploit any content on the Site without our prior written permission.

8. Privacy & Data

• Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

• By using the Site, you consent to collection, storage, use and sharing of your personal information as described in the Privacy Policy.

9. Third-Party Links & Services

• The Site may contain links to third-party websites, services or resources. We do not endorse them. We are not responsible for the content, accuracy, policies, or practices of any third parties.

• If you choose to access third-party resources, you do so at your own risk.

10. Changes to Terms

• We may update or modify these Terms at any time. When we do, we will post the updated Terms on the Site, and indicate the date they were last revised.

• You are responsible for reviewing these Terms periodically. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

11. Termination

• We may, in our sole discretion, suspend or terminate your access to the Site (or any part thereof) at any time, for any reason, including breach of these Terms.

• Sections that by their nature survive termination (e.g. warranty disclaimers, limitation of liability, intellectual property) will continue in effect.

12. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada. Any dispute, claim or controversy arising out of or in connection with these Terms or your use of the Site shall be resolved through negotiation first. If unresolved, it shall be submitted to the appropriate courts in Kitchenen, Ontario, Canada.

13. Miscellaneous

• If any provision of these Terms is held invalid or unenforceable, that provision shall be struck out, and the remainder of the Terms will remain valid.

• No waiver of any right under these Terms shall be deemed a further or continuing waiver of such right or any other right.

• These Terms constitute the entire agreement between you and us regarding your use of the Site and your purchase of Products, superseding any prior agreements.
